I am new to this site and was looking into a code of ethics for our BOD. I am the longest standing member on our current BOD. We have many who run, accept their terms, turn in their resignation, and a few who opt to run again when their terms are up. So we have a lot of new faces to incorporate into the Board yearly. This is exciting for me, because I believe I am into the best interest of our community and believe I represent our homeowners to my fullest ability.

From time to time we have new Board Members who are overly rule happy. They end up taking matters into their own hands vs. following our Association Guidelines set out for all members of our neighborhood.
Examples: BOD whom - approach party's declaring they are on the Board and the party must be broken up (yes vs. calling the cops) - stand in front of cars going the wrong way on the one way strip we have (yes vs. sending in a violation)- chasing down cars that are speeding.

I have read the "ethics" topic and may pull from that a code of ethics for our BOD to sign. However, I am looking to see if others have had this problem, and how they have dealt with it.

CAI has published a set of principles for homeowners associations. It not specifically a set of ethics for bored members, but it may be helpful to you.

ALL new board members need to realize the definition of GOVERNANCE. There are many sources on the net. Simply Google "Condo Board Roles or Responsibilities."

P.S. I find that those people who would approach a party with a puffed up chest proclaiming that they are Board members would do the very same thing, anyway - using a different excuse.

I agree with you on that "puffed up chest" note. However all the efforts the Board makes to unite community and Board become absolete, it seems, when we have a Board Member use their "board authority" as a means to police the community, or unleash/vent their stress and frustrations on community members in the name of the Board.

The worst case scenario around here is - a dog poop incident involving a Board Member and homeowner where poop was a flyin'............

I have with help of fellow Board Members been able to do some real good for the community, but am too the point of quitting unless there can be a clear understanding amongst all BOD that we are to be respectful to our homeowners we represent.

So hopefully after exhausting my resources I will be able to get all Board members in sync with a clear ethics code.

What do you mean "code of ethics" for an association board?

In our bylaws it states that no Board member can act as an "agent" of the association (verbally or to sign contracts, enter into loans, make promises, etc.) without written permission of the Board.

No one Board member should be going around making statements because they are "a member of the Board.' Your Board members need to know that.

When they leave the meeting, they are a "member" of the association, with all those rights, but nothing more.

Yes, I agree 100%. But, getting other BOD to agree to that is the issue. If they do not agree to act that way, can we vote them off the Board. Our Bylaws state you have to have missed 3 consecutive meetings before you can be dismissed.
I am looking for clever ways to get some BOD's in check with their actions. I swear some of them act as if they have some kind of invisible badge and flash it at a drop of a dime if they have had a bad day or are looking for some drama.
I am about to report one Board member for a violation. I pointed it out to her, and she has not corrected it. This is the same lady who had a standoff with a resident going the wrong way down the one way and now she is parking the wrong way on the one way. ??

Tamara, below is a link to a sample code of ethics. I remember when I joined the BOD that I was given a welcome manual outlining what my duties as a trustee were and what the duties of the MC were. You could try something like that but unless your fellow BOD members agree to be bound by it, there is little you can do unless your CC&R's allow it.

As an aside, we had a member like you are describing. One month before the meeting was called to order and we were all talking, I casually asked the guy about his new nickname. Perplexed he asked me what I was talking about. I told him that the H/O's were now calling him Gomer Pyle because they said the way he acted reminded them of Gomer on the Andy Griffith's show running around after people, shouting "Citizen Arrest, Citizen Arrest." He got the point and calmed down and since then whenever a BOD member gets too out of control a few whispers of Gomer or a picture of Gomer left in front of their place at the table gets the message across.

Glen, thank you for your information. I really like your clever idea. We actually have a guy here who was kicked off the Blockwatch because he threw himself in front of a speeding car to stop it. Luckily the car stopped. He was removed by the Police who head the Blockwatch for liability issues........Can you imagine! He is our reference, we just say his name, but I think this chick takes it as a compliment.

I will try the Gomer Pile reference as copying pictures of that one guy may be defamation of character or something.

I would rather make light of it and at the same time get it under control.............if possible.
