Our CC&Rs state owners are responsible for their driveways. The HOA is responsible for the sidewalks, which are only present on one side of our private roads. At the foot of the driveway is a driveway apron. Where there is no sidewalk the apron ends where the street gutter begins. Where there is a sidewalk, the driveway ends at the sidewalk and where the sidewalk ends is the apron. There is no mention of driveway aprons in the rules. Who has the maintenance responsibility of the aprons?

If your CC&Rs don't specifically say who is responsible for the aprons, I'd consider them part of the driveways and thus homeowner responsibility. Reasoning: the aprons have to handle the weight of motor vehicles, and they exist for the benefit of drivers entering and leaving narrow driveways - I've always considered them to be part of the driveway. Sidewalks serve a different purpose and they function just fine without the aprons.

Cathy's reply make sense. I'd agree that the aprons, no matter where they are, are for the vehicles of the owner & guests, solely benefit the owner and so are their responsibility to maintain. The aprons are part of the driveway.

I've looked into this a bit in the past. Our HOA did not have any explicit mention, but the way our county handles it is that the aprons are the responsibility of the owner even if they are on public right of way because they are there for the benefit of the owner.

Look at the plats in your CC&R's. They will tell you what is your property and what ism CE and LCE to the HOA.
