From Bruce : Hi Folks, I was wondering what the rules are for HOA and financial records access for a homeowner. That is besides the annual financial reporting and budget that is required what financial information is a homeowner entitled to during the year? That is can I request access to any monthly reporting the management company prepares? If not can I request access to the records in the management office?

Just as a note the board changed management companies and the old company did provide monthly income and expanse numbers to homeowners who requested it via email but I am not sure the new management company will provide this same access. So I am wondering under Florida law what access is provided.

Can you provide the same for Georgia? My HOA is in Georgia and we are currently in midst of a lot of un-answered questions.
Our board was basically self appointed when no election was held and Covid was blamed for that. Association members have asked for
copies of records numerous times. The current board ignores all email or letters to them.

Someone might look up GA statutes for you, Darlene. meanwhile your own governing documents might give that info. Read them anyway since you're (maybe?) on the Board. Your bylaws might have something. Ours do.

DarleneS2, could you please start a new thread? In your first post, please indicate:

-- Condo or non-condo?

-- corporation or not a corporation (most condo associations and HOA associations are incorporated)

-- Does the Declaration or Master Deed speak of certain statutes applying to the condo/HOA? If so, please state what statutes are named.

-- Year the condo/HOA was established.

Have you googled Georgia HOA statutes? That might be faster than waiting for a Georgia expert to find this thread.

Thank you for posting 720.303(4).
I asked our HOA Board about the Rules Violation fines and the Fine Appeal Committee actions. I was told these were private transactions between the Board and the individual home owner and not public information.

When reading 720.303(4) J - dealing with financial records, it seems that if there is a dollar fine charged to a home owner and/or monies collected from a home owner, that seems to be a HOA financial record that could request able.

As such, the fee / copy costs could mean alot of costs. But, could the records be requested as part of the general ledger, likely only a few pages each month?
