SO!!! first day of no school and someones unsupervised kids were in the park and used a rock to break an owners back window. Earlier in the day our PM reached out about delaying the opening of the pool and should we consider fencing off the park. I didn't at the time feel the need to fence off the park, now with someones kid breaking a window, I think it may be something to consider. I emailed the Board President and get an it's not an
an HOA issue.

I know we can't specifically target children without the FHA raining down on us, but I think in the CC&r's and the rules and regs do require some sort of adult supervision at the park and pool.
But I do think as a board member myself we have a fiduciary duty to increase security patrols. I shudder to even imagine what temporary fencing would cost, considering we were quoted $800 for temporary fencing when thee splash pad and jungle gym pads are replaced in the coming weeks.

What are your thoughts?

As if the kids or others won't damage the temporary fence? Let the police handle this issue.

The HOA is private property and the police won't come out. The police wouldn't even come out when a drunk driver whacked someones car and the victim is a cop.

Strange, LetA. In my part of CA, the police recently came into our gated urban high rise, into the elevators and into our resdential corridors when there was a report of a stranger on that floor trying to break into a condo unit.

And the police won't come into NV "private" HOA neighborhoods?

Wow can I start cooking meth in your HOA if the police can't come in? That doesn't make sense why police aren't entering or being called. It's not that private property. There is more to the story...

A lot of police agencies will not investigate traffic accidents on private property because most traffic laws typically don't apply on private property. Criminal offenses are different. I can't imagine the police not investigating crimes on private property since probably 95% of crimes occur there.

I don't think one vandalism calls for any HOA action, especially closing off common areas. If you had ongoing criminal activity, extra security measures might be appropriate. This could happen anytime kids are out of school, or while school is in session if a kid is skipping.

If you already have security patrols there is nothing wrong with targeting areas where you have had problems.

I agree with Ben. Btw, is the "park" HOA property?

LetA, I think I would call my city councilor, maybe cc'ing the mayor's office, and inquire whether the police refusal to help is correct.

Shut down the park before everyone gets corona virus. Start with closed, no trespassing signs.
