Can board members also be on committees such as violations & archt. or can they only to be 'heads' of committees?

Depends on documents. Ours make no mention of the makeup other than they are formed and members appointed by a BOD vote (simple majority). Personnel removal (i.e. forced) or committee disbanding occurs the same way.

Sometimes, based on lack of volunteers, there is only board members to form a committee.

I do believe that if your documents provide for an appeal process to the Board, then there should be no board members on that committee or at the very least any board members on the committee should remove themselves from the appeal process. This removes the appearance of impropriety and provides the appearance of a fair hearing. It's all about a persons perception.

If you have enough volunteers and good team involvement, then sometimes a board member will be on each committee in an HOA and not necessarily as head of the committee. In turn that board member can in essence give a committee report to the board at their meetings, if needed, and no business regarding that committee is being handled. If business is being presented for that committee then the chair of the committee more than likely will give any presentation. If viable having a board member on a committee insures the board is in the loop regarding said committee business.

Tim has a very good point in that if there is any appeal process for that particular committe the board member should potentially excuse themself from voting on issues regarding said committee, depending on the circumstance.

This works similar to many local city council officials serving as a member on various committees and giving committee reports to the city council.

Thank you, our problem lies with the lack of participation. Owners don't seem to want to volunteer for comm.

Have you thought of having some HOA get together/parties such as a potluck dinner when weather allows in the common area? Sometimes it is neighbors getting to know each other to generate interest in the community. Use this opportunity to solicit potential committee members.

The HOA needs to somehow let members know that participation insures a β€œteam” effort for the success of the community as a whole.

Committees should not be comprised of ALL board members, rather one board member can be placed on the board - not to be chair, but to act as a committee person.

I disagree with those who say board members should recluse themselves from votes. When on a committee, that person is a committee member and has no other extraordinary privileges or status than any other committee member.

Don't wait for "volunteers" for committees - hand pick them from your HOA members. If the duties and time obligations are very clear, most people will step up.

Susan,

I agree that anyone who is serving on a committee should exercise their vote on the committee. However, if that committee member is also a member of the board and the committee's decision is appealed to the BOD, then I believe that the director serving on the committee should not vote on the appeal.
