Hi, I am new to this site and I wanted to introduce myself. I am a graduate student at Regis University working on my thesis which is: "Improving the Home Owner Association’s (HOA’s) sharing of Covenants, Conditions and Restriction’s (CC&R’s) by Centralization and the use of Knowledge Management Solutions".

I was wondering what thought's anyone might have on this? Do you think the centralization of all CC&R's per city, per state, and available to all on the Internet (at no cost) would be a good idea? Would this help realtors, ttitle companies, renter's, buyer's, etc.?

Any comments would be appreciated.

Of course it would. However, doing so would be a mommoth task, opposed by lawyers and management companies whose existence depends to some extent on the confusion inherent in the present fragmented situation.

RobertO.....Congrats...... In Florida all CC&R'S are a recorded document and can be found at the Clerk of COurts office in that particular county via their web site..You however must know the name of the HOA to cross reference.. Not sure how other States file theirs....... LindaC3

RobertO - Any prospective buyer can request a copy of, or review of the cc&r's through their attorney or inquire with the Realtor for the contact to request a review. Unless a person is interested in buying or living in an HOA I don't see the benefit of their knowledge of what the specific cc&r's state. I also think there could be a negative impact upon property values. While I'm all for centralization and ease of information sharing, I like the fact that my cc&r's need to be researched by interested parties with some necessary bureaucratic red tape. As a seller, I do not think cc&r's should be available to "all" on the internet, especially at no cost. I do think 100% that the cc&r's should be available to all owners in an HOA on the internet with a secure password. If as a seller the owner wishes to provide the buyer or anyone the password, than that is at their discretion, where I believe it should be.

I don't mean to be controversial and am delighted to see anyone take an interest in HOA's as a thesis. However, your thesis seems to be like saying, if I do something better, will it be better? Centralization will improve sharing. I'm left saying...so what?

I'd love to see a thesis that takes one of the positions that centralization of cc&r's and availability to all on the internet at no cost has either a negative effect, or a positive effect on property values.

Yes, it would be wonderful to go to a source to find anything that would help to set up or run HOA's.

But the bad news is that each state has such different guidelines and statutes to aid BOD and owners in running these associations. Then each county has seperate laws and codes. Then the individual association have different needs and requirements. For instance a 55+ community (also under Fed Law) is so totally different from an association where there are lots of kids and renters.

In an ideal world, we should be able to go to a manual called "Simple rules for HOA's" but it doesn't sould like a feasable task for you.

An ideal place for you to go to start to research and see what a task it would be is Florida State Statutes 720 which is HOAs. Then if that does not scare you off, go to Statutes 718, which are the Condo laws. Good luck with that one.
