After reading all of the comments - I don't understand why your Owners Association is now calling it a special assessment??? This is a late fee plain and simple. Your declaration should state what the association can charge for a late fee on late monthly assesment.
At no time should the late fee be called anything else - since it is not an assesment.
A lien on your property can be levied for late assesments - not for late fees, unless your declaration states that fact. Please read your declaration if you have a copy of it - if you don't have a copy of it you can usually get own through the county assesors office.

Jody R2 is being conned out of her house for a pittance and the law is letting it happen. Why is this being allowed to happen? What happened to fairness? When will the government finally step in?

I emailed you but no reply. If you didn't get it give another adress. What I was going to tell you is HOW -in Hawaii - after you pay them, you go about making them come up with proof or give you a refund without your having to hire a lawyer. There are several laws & agencies that help you. I have just began this, and it has to be begin immediately before/at payment, ...(to mail within 30 days), but it's up to you.

If 'their' attorney will stop the foreclosure with full payment - or you can negotiate a compromise - make him a reasonable offer - then you don't have to hire an attorney. Just pay him and do the next process.

sorry i didnt get back sooner.i think from talking to an attorney in maui the best course is what you have mentioned to pay and stop whats going on and attack later.there was no compromise at all it was pay this or else.so i will pay and do the next process.
