Hello, folks. I am the newly elected secretary of our HOA, which is, by our Articles of Incorporation, a "road association": the corporation exists solely for moving dirt and movng snow. We have no covenants nor CCRs. I was previously on the Board back in the early 1990s.
I was elected by a vote of the general membership at the annual meeting in June. It is now September 1 and I still do not have the records of the HOA, as mandated by our bylaws and the Colorado Revised Statutes.
I have repeatedly requested, via e-mail, to either have the records delivered to me or to know who has them and when I can pick them up. I have been met with stone silence from the Board.
In Colorado, there are statutes that govern HOAs. Our bylaws are way out of compliance with these statutes (specifically, the Colorado Revised Nonprofit Corporation Act and the Colorado Common Interest Community Ownership Act).
Anybody out there have any ideas?

Send an old fashion written letter with delivery confirmation. Your email might be in their spam folder or they may not check that email any longer. I would send one to the president and the secretary just in case offer to go pick them up, unless of course you are aware of some reason there would be hard feelings.

Who was the previous Secretary? This should be known from prior documentation ... send this person the certified return receipt letter requesting the records and also copy all other association officers. All officers will then be fully aware that the information has been requested. I personally would be sure to note at the bottom of the letter everyone who you have copied (i.e., xc: President - NAME, etc.) Doing this will also let the previous secretary know that others are now aware of the situation.
