We need to update our governing documemnts,from 1969 to the new Illinois common interest community statutes that went into effect July 29, 2010. we need to hire an attoney to do this. Does know about how much we should expect to pay an attorney for this work?

The statutes, if applicable to your HOA, must be followed whether or not the Governing documents are updated. But if you have not amended for over 40 years updating is probably overdue. Cost vary depending on the extent to which you need the assistance of an attorney. Some attorneys in Colorado will amend and restate the Declaration of CC&Rs for $4,500.

Roger, thanks for your response. Yes our gorverning documen are over 40 years old. some obsolite need to be amended and new one added. or rewritten. I was hoping Illinois residents in common interest communities affected by the new Illinois Public act #96-1400 could offer me some advice about anticipated legal fees involved. But thanks for your response.

I live in a community in Illinois with 2100 units, we have just thought about the upgrading of our documents. We also do not know how much assistance we need from an Attorney nor what the cost of this service might be. I expect we are still a few months away from answering these same questions,
