IM located in Florida and would like your advice: Common Grounds Maintenance, our by-laws state thatthey shall maintain all of the common area ,grass,shrubs, lawn care maintence to the portion of the grounds lying between the front building line of each dwelling unit and parking area.

Now in front of our units/townhomes there small section of grass and some units have big trees...whos repsonible for trimming the tree's?


The president of the Association states that its the homeowners responabilty to care for the trees that are in front of each unit.

I tried to explain to the president of the association that the by-laws states lawn care maintence to the grounds lying between the front of the building line of each dwelling unit.

Who planted the trees? If they were part of the original landscaping then IMO it would be the HOA's responsibility. If the trees were planted by homeowner's then they should be the homeowners responsibility, even if they were planted by a previous owner.

The trees have been there for many years.....some o the units have these trees directly in front of there units.....president of the association states those trees in front are the home owners responiblity...our president of the association likes to make her own rules in the by-laws....alls I can say if the other homeowenrs knew that those trees was the association issues they would be real made...some of the owners had to pay a few hundreds to remove those trees dues to the roots on there plumbing.
