I live in south Florida and my HOA has always paid for termite treatment in the past, but now since we switched management companies, all of a sudden they are telling us it is the owner's responsibility. The problem is that I live in a fourplex, where we share the same roof and walls, and I it will be useless to just treat my unit when all the other units around me are also infested with termites. Termite treatment has been a budgeted expense, but still we can not get any resolution to this problem, even after an HOA meeting we had over a month ago, still no answer. I found out from our prior management company that the HOA had purchased a termite treatment bond contract with a pest control company, but when we asked the HOA why they changed pest control companies, their answers were very vague "they just did not do a good job", they said, I just dont' know what to do anymore, I am tired of calling and sending emails to our management company, they seem to put us on ignore. Please advise.

Anita, you need to find the relevant section in your CC&R's that states that the COA is responsible for pest termite control. It may not say termites directly but I suspect the COA is responsible for the upkeep and maintenance of load bearing walls and roofs; basically the whole building shell in to your drywall. If when you show them this, they still won't pay for the eradication then you can either work to recall the BOD or file a lawsuit. You could also get with your neighbors and hire a company to do your building and split the cost. But even if they do decide to pay do not be surprised if they enact a special assessment to pay for it. I suspect all the fancy word play is the BOD's way of saying: "We don't have the money."

Remember maintenance free living is not the same as free maintenance. Someone has to pay.
