Our covenants specifically state a minimun sq. footage for a ranch and for a 2 story home. There are 13 remaining lots to be sold and now a homeowner wants to increase the minimum size by 200 sq. feet. All lots have been purchased from forclosure, under the current covenant guidelines. Is this possible? Trustees are not in favor of the change. The subdivision is in Jefferson County, MO.

This homeowner may be very clever. He may want to keep the 13 remaining lots empty. He may know if you increased the square footage, all the 13 lots bought under foreclosure may be un-buildable due to setbacks, building code, etc.

Tell the homeowner; "you received their request for an increase in square footage. No action taken"

This change would require an amendment to the covenants. If the trustees are not in favor of this change then it won't happen. Frankly I see no problem. One person cannot make this change unless that one person holds a vote equal to the vote % required to amend the covenants!
