Can someone tell me (could a committee member of a HOA be sued, if a resident left a BYOB party and
had a DUI car accident where someone was injured or killed). Would the committee members be liable, and can they be sued.

You and the above poster must be in the same Florida HOA. All of these "could's" would depend on so many different answers of which we do not know. Is a person responsible for someone elses DUI's? It all depends on a wide variety of circumstances. That is why it is not a wise policy to sponsor any events where there is alcohol served. BYOB included. Do you need a license to sell alcohol in Florida and the answer is yes. You can get a special events license which will cover just a special event or circumstance but again, this seems to be a hazardous way to earn extra funds.

I would think the HOA may be held resp if they sold the liquor to the driver. Just like a bar owner may be held resp. for a DUI accident. It might be wise for the BOD to run this by their attorney.
