We have a new HOA website and I would like to post pictures of event in our community. Can someone tell me if there is a legal issue to contend with regarding posting pictures? I think it would be very difficult to have residents sign a release form if you don't know who they are. If someone has experience in this topic feel free to enlighten me.

the rules used to be (an old photog for a newspaper here): Crowd shots are okay, if there is no central focus or readily apparent single subject. Shots of public figures are okay. Shots of players in an organized sport are usually okay, as they gave their rights away by joining the sport. Shots of people involved in a news story are okay, as the public has an overriding right to know versus the person's right to privacy.

The gray areas are the shots of Bob shooting hoops with Ted. One way around it is a simple "generic release", a paper/announcement that all participants at the picnic might be photographed and have their picture published in the community website, newsletter, etc.. You can give them an opt out, where if they disagree, they can file a request to not be photographed.

or, you can do what most people do, and take pictures and post. if someone complains, remove it. if they file suit, there is very little chance there were any damages, so you should be safe from recompensation. Just stay away from pictures of Bob drunk, with his head in a lampshade, etc..
