Does an Association have any rights as to resrict placement of satellite dishes? Our current rule is that they can be installed on the deck, but oppose installation on roofs or siding because we have to pay for the maintenance and repair of these. Plus the dishes are visible on the roof to all that pass through the community, and are not very attractive. We have recently been challenged by a homeowner that we are violating the new FCC laws by prohibiting installation on the roof of a townhouse, and am interested in finding out if this is true. If it is true, does the HOA have to pay for any damage cause by the dish, and also pay for its removal and reinstallation when we replace the roofing in a couple of years?

As I understand the by-laws for most condos show the decks as "limited common elements." Therefore, the dish can be placed on a deck. Where I live the dishes are set on the deck or on a stand or cinder block. They may not be attached to the building as that is a "common element". The roof is a "common element" and placing a dish would be prohibited.

You are not "prohibiting installation", but you have control over placement.

It would depend on if his home can get a signal from the deck.The way our home is positioned the only 2 ways we could recieve reception was from the roof but we had the company install the dish in the back of our home and as low as possible to recieve reception. Our dish can not be seen from the front of our home.

Well, I've read a lot of articles, and most are supporting the HOA's policy, but a couple have gone the other way. According to the homeowner, he can only get satellite reception from his roof..it looks to me that for a townhouse community where the HOA is responsible for maintaining the roofs and siding, we do have say as to where the dishes can be placed..It's not that we are refusing installation of a dish, its just that the areas that we allow don't work for him..they work for everyone else that has installed a dish, but not in his case. Thanks for all of the responses!
