Due to a lingering non-paying owner situation in my HOA, the Board has started obtaining information concerning non-judicial foreclosure; the guidelines in the Texas Property Code stipulate that the first mortgagee needs to be contacted so they can provide 21 day notice to the owner. The current Board is inexperienced, no previous Board ever collected mortgagee information from owners, and I doubt the owner will willingly furnish any info to us - I'm at a loss. Does anyone know of a resource for that info that I'm overlooking?

In my county all that information in on the internet. You can find out what they paid for the house, who they borrowed money from and how much, whether they have pulled permits for improvements and whether they have paid taxes they owe. Try a search under your county property appraiser or something like that.

I can see the tax information through the central appraisal/county assessor's site, as well as additional info like what he paid for the unit, however, there is no recordation of the lienholder. : (

Don't try and do your first foreclosure by yourself. Have an attorney walk you through it. This is a highly explosive situation in Texas, with the legislature being constantly bombarded to remove this right from the association.
