Our community has a golf course with a golf cart path. Numerous residents want to be able to walk on the golf cart path in the evening for their evening exercise. It has become a question as to when to allow or not allow residents to use the golf cart path for walking. Golfers want it restricted all the time so that can play until it is completely dark.. Other residents argue that it is unfair to restrict walking on the golf cart path especially when only a couple of people play late in the evening. We have over 1400 resident homeowners.

What is the prevailing practice?

Someone can tell you for sure. I don’t really know what you can or can’t do. I would think there would be some sort of compromise. Being you have 1400 residents, what about a petition to amend or even to establish a new rule. I would think you would get some good advice from the people that do know what’s best for the community.

Let ask a few questions to help us find you some answers.

1) Is the golf course owned and/or operated by the HOA? Or is it independently owned but just within the confines of the HOA?
2) What is prohibiting people from walking on the cart paths now - HOA rule, Golf course rule, just signs posted?
3) Have you talked to the association's insurance agent about increased liability that might result from allowing people on the same path as motorized vehicles?
4) What is the width of the cart path? Will it accommodate both carts and people?

the developer/ ownes the course where i live it is a issue as Joe has mentioned here are some what-if's the chem, used @ night , the chance of someone going down and no one knowing who or where that person is too many things could go wrong, safty beying paramount stay on the road, hope this helped some way

Joe you have post some really good questions. I think those questions will be helpful to others to help with better advice. You are correct. I didn’t even think about property insurance!

Maybe the golfers can no longer golf after dusk? Which then would take away the liability issue concerning a pedestrian getting hit with “a 100 mph golf ball” This is typically the time, when golfers can’t see to play competitive golf any longer anyways? This is when the walkers could use the path for walking. It will be cooler then anyways.
I hope you all can find a compromise to the whole situation.
