I live in Dallas Texas. My subdivision was finished and the show homes sold and the office closed. We have been trying to get the management company to have a transition committee election. The HOA was formed in 2003 but they have never had a meeting with the homeowners. In the by laws it states they should have a meeting once a year with the owners. I'm not sure why but for some reason the management company doesn't seem to want us to take over the board. We have been promised 3 different meetings dates none of which happened. The last one was August 28 but we have not received any notice in the mail on where or what time the meeting will take place. We have 342 homes. No one here has any experience with HOA. We were hoping the management company would help us. We don't even know the names of the board members so we could write them a letter. Should we write to the developer? What should be the steps we take to get our transition committee in place and working? Please help!!

Michael, go back to the person who promised to set up the meeting. If not available try going to the Secretary of State's web site and look for Corporations. If the HOA is incorporated the name should show up when you type it its name. Look for the most current registration with a name for the agent. There should be a name and mailing address. Perhaps contracting that person, if available, will start you on the process.

Roger gave you some information on where to look. For more information on transition, click on the "Community Associations Network" link to the right and then select "Developer/Transition" from the main menu. There are 4 good articles that I would print off from there:

And as for one of your questions, by all means write to the developer, detailing your requests for information and a transition meeting, based on these articles.
