The street in our community is owned, maintained and under the jurisdiction of the town. The street ownership, etc. was assumed by the town after the covenants were drawn up for the community.

The town ordinance designates it as "No Parking" on both sides of the street, end to end.

Street signs are in place in order for enforcement to take place.

Does the HOA have any enforcement authority over a public street? (regardless of language in the covenants or rules and regulations)

I've been reading your postings. We run along the same lines on situations a times.

I find it absolutely fascinating as to how creative or maybe it's just how diverse people can be in their behaviors and expectations.

I've tried to learn as much about HOAs as possible, but each day brings a new situation and a new challenge and a new avenue to research.

Keep up your posts. I'm learning from you as well!

Joyce, the HOA may still have enforcement authority but this is determined by the HOA's restrictions including the plat which dedicated the streets. Of course you can always monitor and report street parking violations to the City's police department. I would opt for the later as long as they are willing to enforce.

Our situation is that the city controls the streets and we have no jurisdiction. We have had boats, trailers, old trucks parked on our streets. We simply call our police department and let them deal with it. That is what I would advise you to do, let the agency that has jursidiction deal with it.
