I am newly elected onto our Board. The president of our association admitted to post dating about 8 proxys causing the vote to swing. What recourse should we take?

Could you give us more info about what was swung by the forgeries?

And if your docs have a procedure for recalling Board Members?

And why the Prez fessed up?

Void all vote that the proxys had an impact on. Draft a letter to all members informing them of the situation and announce that another vote will have to be held to rectify the situation. In this situation, do not throw the president under the bus. People will catch on to what is going on, but do not let that news come from the Board.

As a Board, you need to address how the President is going to be dealt with. Either he resigns or he will be removed. I assume that this was not an accident (not sure how it could be)?

Thanks for the reply. It was not an accident by any means..our association conisists of townhomes and condominiums. She resides in the townhomes. I reside in the condominiums. The votes that changed resulted in another condo person not being elected onto the board.

I do not agree that another election will have to be held as David suggests. Rather the proxies that arrived late (the ones the Pres changed the date on) will have to be voided and all the other votes cast counted. I see no need to hold another election. Inform the members that there was an error discovered in counting the votes. Any member who wishes to view the ballots should be allowed to do so -- including those members who's names were on the ballot. Make certain the voided proxies are available. The board should make certain these ballots are kept, perhaps for a year considering the mistake that was made.

What a mess! I'd declare the election null and void due to improper procedures and mishandling of ballots.

Then you have a "vacancy" which can be filled by the board or the president. Just appoint the same person to fill the vacancy.

This is a reson why there should be a teller who counts all ballots and reports the results to the presiding officer, who then announces it. Why the President was handling ballots is a mystery to me.

No one should be handling ballots at this late date. Voters' right to anonominity and privacy is at risk.

I have no advice, but this is unbelievable!

Not that I don't believe it, just that -- Why would someone DO something this stupid? And then admit to it??
