Our development was completed and turned over to 5 appointed board members by the developer/builder in April. This is a brand new development, and we are espablishing the new HOA here. A few questions have come up.

1. Does our term run from April 06-April 07, or can we use the calendar year and turn over the board in Jan 07? (we have assessed the development stating it is from April 06-April 07).

2. If a member of the community fails to pay his/her assessment, do they have voting rights during the annual meeting? (This is the first meeting of the HOA, and many issues are on the table) We suggested sending out a letter stating if payment was NOT received by the meeting date, no voting rights.

I look forward to any and all replies in helping us reslove these concerns.

Mary Ann- I congratulate you on taking an interest in your community. This site is full of discussions and is very informative to me. Many of the responses I have gotten have been very useful. I wish you all the best in your adventure!

I’m learning about HOAs myself. I’ve read all I can on this site. I use the search engine a lot. If you use the search engine, you will find many discussions on delinquent assessment, establishing an HOA.

It a big responsibility to take on, with the help of this board and all the knowledge each of them will and have provided. I can see you having much more success with this.

Mary, your first question should be answered in your By-laws. The By-laws can be easily amended at a meeting of the members to fit the members desires. YOur second question should be addressed in your By-laws and/or your Declaration. If this item is not addressed in either document you can amend the By-laws. The Declaration is much more difficult to amend and prevails over the By-laws.

Mary,

Our docouments read 'eligible association vote' which means only those members in good standing can vote. They also reduce the total eligible vote required for amending the covenants, etc.
