I just got a call from a home owner that recieved a letter on Friday threatening a lien if past dues were not paid in 10 days of the date of the letter. (That alone bothers me because the count the weekends and this is also Thanksgiving week which means they will be out of the office during two week days. That gives people three days to get paid up). They had forgot to sent in their quarterly dues. A late notice was never sent and there was no opportunity for a hearing as the covenents state should be done. This is not the first time this has happened. The BOD has never been contacted by the management company about these, but the letter says that they are the ones authorizing the liens. The developer is still in control and will not get rid of the management company. Our association is in NC. The management company has been in the local news before about doing this same thing in other neighborhoods. How do we deal with a company that does this? Any suggestions would be greatly appreciated.
