What is your take on the “South Carolina Homeowners’ Association Act” (S1283) that is currently winding its way through your state legislature?

This could be an extremely important piece of Legislation for HOA' in SC. I have found out that the enfoprcement of this bill and oversight will be given to SC Comsumer Affairs office. The legislation did not make the floor last year because of doubts about how well it was written. This year it will be re-introduced and restructured. The legal department of the Consumer affairs is hard at work trying to gather feedback from HOA's and HO's. Let's notify them of our interest in this bill and volunteer to provide this office with some grass roots information. The name listed below is a lawyer from Consumer Affairs and although I offered some personal opinions she seemed very receptive and accomodating. I was very impressed.

I am concerned that the committee is puting this bill together is going to be top heavy with Builders Associations, Developers, Real Estate people and Lawyers. Not a bad thing necessarily but my experience indicates a balance of HO's living in condos and HOA's could temper any Turn-over, declarations, and Covenant requirements that are routinely added to favor the developers at turnover time, IMHO.
