We are a very small HOA (4 complexes) I must do most of the organizing as one is a rental, one is an older lady and the other member really has not interest. I just need legal forms for a owner not paying dues and the legal info on dues. I do not want to do something that is not legal in the amount paid each month. Could you direct me to the proper place on these issues. Cathy

Cathy, check you Declaration and By-laws. Usually the Board or certain a percentage of the members present at a meeting can establish Rules and Regulations on delinquent assessments. This can usually include late charges which are high enough to encourage prompt payment; filing a lein which includes charges which are high enough to get payment before fileing if the late charges aren't enough encouragement; turnover account to an attorney if the major cost of this threatened action still does not encourage payment; and finally foreclosure if allowed.
