My HOA has not be active, no meeting, collections of fees and our charter has been forfeited since 1996. How do we go about reactiving the HOA. We have 10 new homeowners since 1996 how do we go about getting activated.

You'd likely have to check into the laws for your state to see what you need to do. Start with your state's web site
I am originally from MA, where it is not easy to do. I now live in IL who has very current legislation on the books, and it is fairly easy (forms, notices, etc.)

In Cali we have the Davis-Stirlings Condominimum Blue Handbook. But first you can send certified letters to the board, keep all receipts, next form some homeowners that want to be on the board, use your bylaws for guidance, then when it is time for your annual homeowners meeting you and the other homeowners can have an election and take control of the board.

At the annual election you and the other homeowners can vote them out. Also you can write to the attorney general about your association not having annual meetings and they can enforce it.

If nothing has been done since '96, then first get yourself re-filed wth the State. Call the Attorney General's office and ask about finding your previous Annual Reports as a non profit corporation.

Get a group of people together and find your bylaws, any old board members who still want to particpipate, and fill vacancies in officership positions until you can have your Annual Meeting.

Are there any minuters from the last meetings? What about treasurer's funds? Accounts?

First of all, is this a mandatory HOA or voluntary? Also, was the HOA incorporated? If so, I would suggest contacting the Sec. of State's office. That is generally the state dept in charge of corporations and corporate filings. If not, then they can tell you who to contact. You will probably have to file an annual report and perhaps pay a penalty. Do you have copies of the gov. docs of the corp -- articles of inc., bylaws, CCRs? I'm curious to know what happened to the monies in the treasury and who has been maintaining the common areas over the last 12+ years.

Though, it might be helpful to someone else driving by. . . I don't think Ruby is going to be responding to any of our inquiries.

I have to comment, though, when I first saw the subject line, "Reactive HOA", I was thinking it meant something different.

I thought it meant "reactive" as opposed to "proactive," not "reactivate."

And the first thought that went through my mind was, "Gee! That's us in a nutshell, isn't it!?"

It would be so nice to be able to spend the majority of our time creating, planning and developing for our HOA, as opposed to the majority of our time putting out fires!
