what can owners do if the board members are very very slow in inforcing covenants.we are concerned the association may lose the right to enforce them.

What do you mean by slow? And how do you know they are not being enforced, maybe the homeowner is slow to respond? Depending on the process outlined in your documents, the length of time to see results may take a while. Maybe the homeowner is being fined for each day they are in violation.

Typically, the HOA sends a letter stating the violation. Then they send a second stating a correction is required within a certain number of days. Then a third letter is sent stating a fine will be issued. If the homeowner doesn't comply, we fin $25/day until they comply.

we have the same problem. one of our board members want
comply but the other board members are scared of her because she has the reputation of sueing about everthing

I too had this issue as a concern. I was also told by our property manager that letters have been sent to the homes of the violators. They just haven’t complied with them yet.
My wife and I walk just about every night and we see violation after violation. I am a person that will report your unkempt lawn to the BOD! I know that many reading this post aren’t too pleased with that. All I will say to that is ā€œsomeone has to do it.ā€
I have gotten violation letters as well. I’m not offended. It’s just a reminder that at this point in time, you are violating one or more of the CC&Rs. I built a home in an HOA community, for all the benefits as such a member. In order to reap the benefits of an HOA you must have them enforced.

I was wondering could an HOA change the way they issue a violation notice. I mean instead of calling it a violation letter, couldn’t you call it a REMINDER. It would be the same procedure as far as fines and a required amount of days to comply.

I think this would be a better way to enforce the by-laws instead of the VIOLATION LETTER. In our community, this letter has offended many of the violators in our neighborhood. If this is the way it has to be then, I’m sure the violators will get over it!

Chuck, your suggestion is a good procedure however it often can depend on what procedures the Board want followed. As a MC we try to get Agreements which allow sending a warning notice first. Then if there is not compliance within 10 days a violation notice which states the violation, the specific location in an official document which lists the restriction, a deadline for correction, and if not corrected a fine after the right to a Hearing which they must request upon receipt of the violation notice. And they are referred to their copy of Rules and Regulations on Enforcement of Covenants and Rules for additional information.

My sympathies. I am the pres of our HOA. We are having some problems because of a number of issues. The bottom line is that people are complaining about receiving reminders/violation letters/whatever you want to call them. They whine that we are not enforcing fairly, that we are fining, that we have no legal right to enforce, blah, blah, blah...
One fellow complied re removing a trailer from his yard, complaining all the while. Now it is back.
Another guy is mad because we won't let him have a farm (wire)fence for his dogs, even though it is strictly forbidden in the CC&Rs.
People seem not to want to follow the rules. Rather they want to blame the Board for trying to enforce them. My entire board is ready to resign. No one is going to replace us.
Why do they buy into a restricted neighborhood in the first place? I guess I just need a pep talk. My once friendly neighbors have gone crazy!

i agree with a better way would be to handle it.
let people know that it is a reminder. but our board has let viotators go for so long that i don't think there is any controll and more except when they need more money for something

i would like to have a president that would treat everyone the same. if you are in there little click then you can get away with just about anything.
we have 2 houses that are adding on rooms, from the road one of them look like crap and another looks good, but the board is harrassing the one that looks good and other just keeps on building. so they don't treat each person the same. one guy was over the building committee years ago so he does like he wants. maybe if our board would resign then we could get more people to help but most of our people are scared of the board.
