We have a row of townhomes in our community that was just completed approximetly one month ago. One of the units in the row is the "new model" home and an investor has NOT purchased it for the Declarant yet. Once no one officially owns this home, is someone required to pay the monthly HOA dues? Someone being the Declarant and/or the Builder.

Thank you for your advice on this one. I have been reading my By Laws, but have yet to find anything on this yet.

If it's a model home then it's owned by the builder/declarant. Whether he is subject to paying assessments on unsold properties should be outlined in the declaration (CCRs). I doubt that would be addressed in the bylaws, but stranger things are known to happen!

He might get away with it, if it's perceived as an "office" right now, not a resident on the market.
