I guess that means that when you smile you can's smell anything? It doesn't pass the "smell test?" |

| I wasn't suggesting that you "direct" the trimmers. But if the job was of consequence (or I didn't have the tools) I would simply approach the lead and ask him for a quote if he could get "my tree" while out on property. Thus you are entering a separate contract with the leader of the crew. No doubt he has been directed that this isn't part of the HOA already. But if you ask him how much, then he is free to give you a quote. Good chance it will be very cheap since all he has to do is ask a guy to take care of it. If something is said simply tell them you contracted separately for the service. |

(did it work?) "Well, I suppose we are all entitled to one mistake in our life . . ." Hey George...maybe, but, I did move to Illinois after graduating.... Hi Kirk - I'll try your idea. They trim trees in Jan./Feb. timeframe....so I guess I better have my boots and coat handy when I see them... Where are you in Texas - were you impacted by Ike? Hope you all are doing OK. Thanks, Bonnie (3 pages on a tree...I looked up burr oak - they can get 80 - 100 feet tall and live several hundred years. Guess the oak wil be here after the buildings are long gone!) Also, the Arbor Day Foundation provides 10 free trees for a membership ($10?) - thinking of forwarding to PM to send to Board...association need to replace 2 downed trees.... |

I live north east of Dallas. We had wind and rain as the storm passed by us. I received about 1 inch of rain yesterday. Today though it is absolutely beautiful out. Now the question is: what to do about the tree when you are gone? Or what would they do about the tree should you sell? Does it belong to the unit as long as it stands? I know it sounds petty, but it is something they should think about. If it belongs to the unit, then when you sell the next unit owner may decide they want to turn it into a giant bonsei tree (or worse). |

| Hi, Bonnie. Just read this 'tree thread'---very enlightening and will be sharing this with a neighbor of mine in our HOA minus and the (funny)jokes. Though it has been established this is now your tree, is the BOD 'sticking'(no pun intended) you with property taxes? -ReneeD |

Hi all, Kirk – I’m glad to hear you had minimal effects from Ike. My rain gage showed close to 9 inches over 2 days – no flooding by my home, though – but the Chicago area has a lot of flooding (I’m about 50 miles outside of Chicago). As to what to do about the tree when I decide to sell - normally any approved alterations or additions done are to the dwelling unit’s exclusive limited common elements (windows, garage door, front stoop, deck or patio, patio or deck doors, etc.) – not for the common elements – and such remain with the unit’s associated exclusive limited common elements when it is sold. I will consider asking the PM, except she will forward to board, and I may not get what I’m looking for - been there already I just had another thought - sat. dishes are approved for installation in the common elements. Is this a similar situation? HO is responsible for dish removal unless new HO wants it. The board hasn't been thorough in the past about ensuring their removal, though - but that may have changed. Renee – my tree issue has been a learning experience – of course, share it. I would add a disclaimer that my Board’s decision does not constitute a legally based decision as they told me that they wouldn’t spend $$ for a legal opinion. Glen – I like your idea to complete a Quit Claim Bill of Sale. I also checked the web – how do I ensure association will accept; can they “quit claim” it back to me; do I need to put in newspaper? I’ll continue to research. Thanks, again, for your responses, Bonnie |

Well, if your tree were here in my subdivision, it would be a moot point right now. We caught the tail end of some Ike winds yesterday and our community has been without electricity (and internet !! ahhhhhhh !!) until just a little while ago. Most the trees on the common ground in our area are now collections of twigs, sticks and branches. We had sustained winds of 50 MPH with gusts up to 78 MPH. |

Michele, Sounds like it's time for the clean-up crew to get out there and do their thing! Hope your home didn't sustain any damage. Over the years we've experienced the wrath of a hurricane or two; it's never a pleasant experience. I was happy to no longer be living in Baton Rouge when Gustaf went through. But, we did get the aftermath of one that went through before we moved away about 22 years ago. I still remember the awful cleanup (and a acre lot!) and my husband was already out here in AZ!! |

No, we sustained no damage. Well, our neighbor's fence collapsed into our yard, but my yorkie considers that a prayer answered! We had no homes damaged by trees, but quite a few of the trees in the common areas are pretty knocked around. We've lost a few, others will have to be trimmed in places. We were very fortunate. |

Mary – with all of the rain it has indeed grown another foot! Michele – I’m glad the damage your association sustained was primarily to the trees, and that people and homes came through OK. Would you like a nice oak tree? From my research, they are very hardy – and, they are used for wind breaks. BTW...the Arbor Day Foundation provides 10 free trees for joining ($10.00) - plus reduced rates for trees. I am passing this info to our Board to consider. |

Bonnie: Both my dad and I have received those trees a couple of years in a row. We had a board member offer to donate a couple of them (the Arbor Day Foundation trees) for one of our common areas! I copied this thread to her and she's having second thoughts! But I told her if she decided to do that to be SURE to get it in writing that the HOA agrees to be owners of the trees and is responsible for upkeep and insurance, etc!! |

Hi Tamara – Sure…I am in Algonquin – about halfway between Rockford & Chicago. Hi Michele – have you been happy with the trees? I am guessing you have been since you have ordered them a couple of years in a row. As for the HOA, my suggestion is to approach the Board with a motion to join the Arbor Day Foundation with the HOA being the member. I called them and they told me that HOAs (or other organizations) can be members. Then the Board can decide on the trees to receive, and there would be no question of HOA ownership/responsibility. Besides the $$ savings, I see this as a way to replace older trees that die off by planting these “12 inch sticks” now. That was the size of my oak in 2000 – it’s 8 years later and it’s over 10’ tall. I am hoping my Board has a long range vision! Good luck with the trees! Bonnie |

Hi All, Do you know if your Counties give away trees for Arbor Day? Here in Chattanooga, we wrapped and tagged 3500 trees that were given away at the local malls--for Arbor Day and I know that a couple of communities in Florida also do this. It might be worth checking into. They were all bare root but the 13 that I took are 4 feet tall already since March. |

Donna – a good idea! Now that I think about it, it might have been a county that gave away the bur oaks when I got mine. Worth checking into. Tamara – a small world indeed. What business do your parents own? |

Tamara - I didn’t know the Good Feet store had opened on Randall – just looked up location and it is within 2 miles of my home. I’ll be checking them out – especially with my foot problems. It is a small world indeed! Bonnie |

Hi Tamara, Thank you! I will be sure to ask for Debbie or Larry when I stop in. It will likely be a couple of weeks, though, before I will be able to as I am not currently driving (medical – I’m going for an occupational driving evaluation next week & expect to get the OK to drive). And, yes, Algonquin is a beautiful area! My HOA has beautiful grounds and open space and I do love it here. To get back on track, I am going to approach our Board with the Arbor Day trees offer and hope they will consider it. As for "my" oak, I’m will follow through as stated above – I also have an appointment with the HOA insurer about switching my coverage (for my condo) and will have them formally check into liability on the tree. God bless to you and your family, Bonnie |
