Michele,

I think you've misread what I wrote. The requirement for a certain % of members to petition the board is only in the event the board is "not" enforcing the CCRs.

well anyway after contacting an attorney versed in HOA matters today, I am extremely depressed! He stated that in Oklahoma I would have to sue the individual committing the violations rather than the board. Huh? Anyway to do that if the violator doesn't contest the suit in district court then it'd cost about $2500 and if contested could reach $15K quickly. I'd be better off selling my home taking a loss and getting out of this lame HOA community. Nothing is enforced, nothing...boats, trailers, commercial trucks, weeds, structural changes/additions to residences, parking in the streets, trash cans, weeds, you name it nothing!!! And the board just changes whose in charge...the same two over the last two years....residents are totally apathetic....

I guess I'm left with little choice, spend money I don't have, put up with the neighborhood, or sell and be stuck renting/leasing for the foreseeable future....none of which is even remotely attractive...arg!!!!!!!!!!!!!!!!!!

Actually, there is another choice. You could talk with your neighbors and speak about getting the neighborhood looking better. Ask them if it seems the neighborhood is not what it used to be. Engage them in the conversation about how it is too bad things have gone downhill.

It is possible to get people to act, you just have to be realistic about the numbers. For instance, if 100 people are upset with you then perhaps 10 to 20 will actually bother to show up at a meeting. And you might have 2 or three actually wanting to "get involved."

So you task (Should you accept it) is to find those few people. Make notes of your conversations. Getting proxy statements is relatively easy. You just have to pay attention to those who want things to change (And may not be willing to do anything.) Then you knock on their door with proxy in hand and ask them to sign to allow you to represent them in bringing change.

If you find two others in your neighborhood with a real desire, you can completely change the face of the neighborhood. But don't expect change over night. And if you come to power you will need to gently work on improving the neighborhood. Tighten up over a period of time.

Kirk I am pretty much not liked in this neighborhood because I've made it very clear I don't like people (their kids/dogs) on my property and have filed trespass charges on a number of them. I've also tried to work through the city to use the ordinances and they have been told by the city who has done it so getting anybody's cooperation would be a miracle. The HOA Board and many members are fully aware that I think CCR's should be enforced as written for a variety of reasons but most of all because they are legally bound by them.

Judging from the last two meetings of the general membership apathy rules and people just don't care unless they are directly affected. Less than 5% of the membership showed up which from what I've been told is typical. They are in their own little world without a clue...sorry to be so cynical, I've tried and the only thing it has gotten me is harrasement. They just don't see any problem...they will when the neighborhood falls into complete disarray and their home values decline. Out of 86 homes in our HOA, there are at least 15 for sale. One of the new ones finally sold last month after a full year on the market. The sales of new homes has been so slow that the builders are now turning to straight out leases to get them occupied even though it is against the convenants/restrictions. The HOA is aware and ignores it. All this in a neighborhood that is less than 3 years old.

I just don't see this as an alternative knowing the people in this area. I'm just tired of seeing my money go to the pet project of the BOD (a playground). I get absolutely nothing for my money!! I might as well flush it down the toilet. [sarc off]
