I read through our covenant and it is stated that developer is not required to pay an assessment. The assessments are paid only by lots where there is a living resident so this also excludes about 6 market homes. Our HOA is in debt over 100K already.

What can we do as residents of the community?

Chad, you may want to get an opinion from an attorney to see if these Covenants discriminate or otherwise violate some law in your state.
