There was another thread on here discussing speed bumps, and it sort of got hijacked to discuss No Trespassing and posting signs, etc.

Well, as it turns out, our Private Property, No Trespassing, Violators Will Be Prosecuted signs just arrived.

My husband was delegated to post them on the fence around our retention basin/pond.

All discussion of their "effectiveness" aside, my question is, on which side of the fence should they be posted?

Should they go on the exterior perimeter, facing the outside, but not visible from the inside?

Or should they go on the interior perimeter, facing inside, but not visible from the outside?


PS: I am well aware that the signs themselves do not prevent trespassing. However, again, the residents are happier that we are posting them because it gives the perception of "security," and we want them to know we are listening to their concerns, and it makes our attorney happier because it adds yet another layer to our "you were warned" in case we do need to have someone removed or have them charged with criminal trespass of some kind. (I posted the Kentucky Revised Statutes covering criminal trespass in the other thread, and signs are not necessary for criminal trespass in the X-degree as long as there is some other indication of the private property, such as a fence, which we have.)

PSPS: We have a larger sign in the only entrance to the area that states: Private Property - For use of XXXXX XXXXX residents only - NO boating, NO swimming, NO ATVs, NO motor bikes, NO scooters - Violators may be prosecuted under KRS 511.070-090.

How about most facing outward and 1 0r 2 facing into the pond. How many signs have you got?

I could "borrow" some electric cow fencing from down here. That would work.

We have a total of 5 signs.

Maybe three on the far outside exterior (facing towards the outside perimeter of our community), and 2 inside on the opposite side of the pond, so those climbing over the fence on the far side (and stepping over the ones posted there!) can see them across the pond as they climb in. . . ??

If you have a parking area near the pond, then I would place one on a sign where it will be seen from the parking area. (The idea being to tell someone who drives in to go fishing/swimming that the pond is private and they are not welcome. Though I would be more inclined to place a sign saying "Great HOA Residence Only" there.

While I don't think the signs are perfect, I think that at least in some places they would prevent a few people from coming in. And in some places a fence is not enough to make a criminal case for trespass.

In our case, we posted signs on posts facing outward (no fence on exterior sides) around the exterior perimeter of our ponds. Ours include language addressing no trespassing, private property, and no fishing, no boating, etc. We posted the signs to limit the HOA liability should someone trespass and get hurt, and to reduce our insurance premium. We have also had to send reminder/warning letters to HOs who have used the frozen pond for ice hockey.

We also have large dry areas (grass field plus dry detention ponds). We posted a different sign to address trespassers and dog poop – no trespassing, private property, pick up the poop per Village Ordinance. We have "pick up the poop" signs at several locations along walkways across our property. I do not know if these have had any effect, though.

hehehe, I can assure you, our ponds never get that frozen here!

We do have two larger signs will all the NO this, that, and the other on them, and the are being posted at the only entrance to the common areas.

These others are just sort of generic "no trespassing, private property" signs.

We are posting them on the exterior perimeter of the fence, facing outward.

There is no parking area at all near any of our common areas, including the one with the retention basin.

The only access is by a sidewalk that runs between two homes.

We built a 3-rail horse farm-style fence around the retention basin, with a large gate on one side, for the lawn people to get their equipment through (it's locked), and three concrete posts at the end of the sidewalk on the other side so that ATVs couldn't get back there. Motor bikes still can, as can scooters, since we didn't want to completely block that access from people with wagons, strollers or wheelchairs.
