A neighbor has a golf cart that he has been driving on our public streets. Another neighbor called Highway Patrol, who told him that it was a violation of state law but the HOA should inform him of this and call the HOA if he continues driving on our streets. We are in the midst of much turmoil and I am not eager to jump in where we don't need to. Advice?

Valerie, is this creating a serious enough problem to get involved? If not don't jump in. The highway patrol probably has better things to do than trying to catch a golf cart being driven on a public street without a valid vehicle tag.

If it is something the HOA wishes to enforce one solution is to photograph him driving on the street without a tag and send him a nice note with a copy of the photo. Advise him this is a violation of state law which the HOA assists in enforcing. Request he cease. If he doesn't then photograph him again and provide a copy of both pictures and the letter to your law enforcement. Request they contact him and enforce the law.

roger's right.. in general, i advise that HOA's enforce HOA rules, and let the City, county, state and feds enforce their rules. For instance, i do not try to enforce fraud, bunco, theft, illegal immigration, or speeding. I will enforce paint colors.

Unlicensed vehicle on a PUBLIC street is a city matter. If your streets are HOA private, however, then it is your responsibility to deal with it.
