This YouTube posting of FOX news report from Austin, Texas has been around for a couple of years, so most people have seen it. If you have not seen it, take the time to view the report on HOA abuses, the Texas legislature, CAI, and Associa. It is enlightening.

The Senator they mentioned in the news report is Sen. John Corona. He owns a large management co. and is very powerful in the State Legislature. The problems they talked about in this report are problems we hear about all over the country. The bottom line is that we DO agree to abide by the gov. docs when we move into an HOA; but we do NOT agree to live under the dictatorship of a BOD on an ego trip! The biggest problem I see is that most states have no oversight -- there is no state agency to go to for help, whether it be to settle a dispute or obtain some educational material. Another big problem, IMO, is that many states have nonjudicial foreclosure power which is not friendly to the person being foreclosed upon. In these states (TX is one) the rate of foreclosure is much, much higher than in states (AZ) with judicial foreclosure. Also many states allow foreclosure not only for delinquent assessments but for fines and penalties for CCR violations. AZ law prohibits the latter.

Typical anti HOA rhetoric masquerading as news; how dare the HOA send someone a violation notice, they must be evil megalomaniacs set on world domination. Are there out of control HOA Boards? Certainly there are, there was a news report a year or so ago of a HOA that rented a helicopter to inspect someone's backyard because they couldn't see it from the street. But IMO these are the exceptions not the norm and as long as you have people and their personalities involved stuff will happen.

I agree. The sections of the "violation notices" they showed were improper garbage can storage and yard maintenance. All things that are part of the restrictions the homeowner agreed to before buying.

When I see a report like this, it always brings to mind to me a skit that Weird Al Yankovich did in the movie "UHF" mocking Geraldo Rivera's "what's in Al Capone's safe" debacle.

Weird Al is do an "investigative report" on the contents of what might be locked in the glove compartment of Al Capone's Glove Box (in his car).

It's hilarious!

The camera closes in as he uses a crow bar to open it and Weird Al turns his face into the camera:

"Aha! ROOOOAAAAD Maps!!!"

I'm in agreement with MaryA. In Maryland it is quite easy to use non-judicial foreclosure to steal someone's home by running up fines. The Maryland legislature passed homeowner-friendly legislation against bank foreclosure abuses in 2008; maybe this year they will work on HOA/condo foreclosure abuses.
