| Not to rain on the parade but wait till you get next years insurance premium bill to see if they jack it up. Might need that 4k to pay you new insurance bill. |

Susan, I don't think luck had anything to do with it. InsCo paid the claim, IMO, because we made a strong, convincing pitch as to why the Maple was covered. Between Agent/Principal law, and Contract law (here, Detrimental Reliance on the HOA's part was the key), plus the email records, InsCo would hard put to deny coverage. Having said that, and having broken down both sides' possible positions, I did develope an argument InsCo could have made that, had it been presented, we might have dropped the claim. But it was not presented nor probably considered. DJ, Yes, an increase in premium is theoretically possible, but maybe in the $10s or $100s, not $1000s. Though even there, based on the cover letter Adjuster sent with the check, it appears InsCo still (?) doesn't think the loss was covered under our policy. Rather, it was paid (she wrote) based on "Agent commitment." In any event, we're happy with the outcome. |
