However, this is not an automatic avenue afforded h/o's who've recieved violation notices. A claim must be filed with the OAH and there is a $550 filing fee. If the h/o prevails the filing fee is paid back to them by the HOA. In recent months, a number of the decisions have been appealed to Superior Court thus imposing a financial burden on the h/o and defeating the purpose of this venue to settle disputes.


The Arizona situation is an interesting one--lots of conflict in the past which resulted in the Office of Administrative Hearings appeal process.

I doubt that Indiana would go for another supervisory/ regulatory commission.

However, there is precedent for the Office of Consumer Affairs in the Attorney General's office being involved.

Question: Any thoughts about "taxing" (i.e., assessing an annual registration fee for) homeowners associations in order to pay for oversight by the Office of Consumer Affairs? I think such a fee would be the only way it would fly. It would also galvanize a lot of opposition.

Such a fee would most likely be based on the number of members.

George, Florida did something similar in that they charge a small fee each year to condos to help sort out problems. Below is from another post of mine:

And how would you pay for it because the government doesn't do anything out of the kindness of its heart? We could maybe follow Florida's example with their Condo Trust Fund where they charge condo owners and developers a nominal fee of $4.00 annually which is designated for programs to help educate condo owners and pay for enforcement of condo laws. They even have a surplus in the fund of 29 million dollars or I should say they did. Seems the politicians' decided to raid the fund to the tune of 10 million to make up for budget shortfalls elsewhere. (The Governor wanted to take 20 million but cooler heads prevailed.)

Montgomery Co. MD has the Commission on Ownership Communities. I believe the fee is $2.25/unit/year. It's an all volunteer commission and I believe it's been quite successful over the years. They also provide training for members and board members.
