As a homeowner do I have the right to access certain documents. My question: You have probrably read my posts about our washer and dryer, I called management about our washers and dryer and got our managers assistant. She said she would send a message to our president regarding my question on a formal document telling homeowners they need to remove them: She then replied with an edited reponse. She took the response the president sent her and copy and pasted a reply into an e-mail to me. I replied that I wanted he actual reponse (e-mail) not an edited version. She never sent one. Do I have the right to request that and have it sent to me? It is regarding a question I answered and I would like to know what the entire response was... Thanks. P.S. I hate to abbreiate homeowners, but it's so much easier, except it looks bad...haha |

| My mistake, she did reply back to me: she forwarded me a copy of the newletter, not the e-mail I requested. |

Kim, Why not just ask for a copy of the rule. Doesn't the board have all the board-adopted rules written in a document that can be copied and mailed to you? These rules should be mailed to each homeowner immediately after being enacted by the board. |

| I have the rules. But they, to me, were not very clear. The question is how can they approve some homeowner approval (president) and not others (non BOD). I would still like the e-mail, it is a formal document, I should have access to it. I would like to know the full reply to my question. |

| Short answer yes you are entitled to see it. It is an official document of the HOA and unless it was cc'd to the HOA's attorney not privileged communication. Oh but wait, the MC broke whatever privilege might have existed by "sharing it". Does this mean that they'll readily turn it over? No you'll probably have to get an attorney involved to get the whole mess cleared up. |
