Here is a good one for you. Florida Condominium State Statutes are 718. Florida State Statutes for Homeowners are 720. Some owners here, think that they can "borrow" the wording from 720 and apply it to 719 to suit their needs. We keep telling them it's not possible, but they keep insisting they're "all the same".

Can anyone reiterate that what we're telling people is correct? There is no "co-mingling" of state statutes.

You are correct. But, that would be hard to prove to someone. It seems to be a matter of common sense - read them the document titles.

Anna,

If you want to print this out for them

FL. STATUTES FOR HOME OWNER ASSOC.S ARE 720:

FL. STATUTES FOR CONDO ASSOC.S ARE 718

FL STATUTES FOR NOT FOR PROFIT CORPS, including condos and HOAs are 617 and are shared by both.

The 2007 Florida Statutes

CHAPTER 720

HOMEOWNERS' ASSOCIATIONS

720.302 Purposes, scope, and application.--

(4) This chapter does not apply to any association that is subject to regulation under chapter 718, chapter 719, or chapter 721 or to any nonmandatory association formed under chapter 723, except to the extent that a provision of chapter 718, chapter 719, or chapter 721 is expressly incorporated into this chapter for the purpose of regulating homeowners' associations.

This is pretty clear to me, that condos are not included or share these Statutes except where specially noted
