My question is....

As a resident can I request the minutes from taken
in executive session as long as names and addresses
are whited out?

Not only the names and addresses of assn members is considered sensitive material; also certain issues being discussed can be considered confidential. I would say the minutes themselves are confidential and cannot be released to uninvolved members.

You may want to check to see if there is a state HOA law addressing a member's access to records. In AZ, the board may withhold from disclosure "meeting minutes or other records of a sesion of a board meeting that is not required tob e open to all members."

UNLESS YOUR DOCUMENTS SAY DIFFERENTLY (BYLAWS, CCRS) the proceedings from Executive Session are closed, (except for the Board and any invited guests) AND all persons attending are required to honor a code of silence about what happened at the meeting. Minutes ARE taken, however, they are confidential and not even kept with the regular Minutes of the Board Meeting.

The results or announcment of any decisions MAY be announced in regular Board meeting, but all the debate and voting is strictly private. If an action motion is a result of the ES, then of course, the results will become public.

Going into ES should not be done lightly or often. The meetings usually concern discipliary, staff problems, or legal issues.

So . . . No, you cannot ask for the minutes from ES.
