I don’t necessarily have legal advice to provide to you. Although, it appears that others didn’t either; just adding my two (2) cents.
However, as previously suggested; I would contact your local codes officer (health inspector, for your area). Prior to calling; I would inform the B.O.D of her blatant disregard for the “rules”.
I would have a field day if I had witnessed what you had observed, a board member doing! I can assure you ALL of that.
*BTW* is there anything written in your covenants concerning pets in the pool area? Unfortunately, either way you precede; you will likely as previously stated, be putting your entire community in jeopardy, “IF” the pool is shut down!
THAT SHOULD BE THE BOARDS MAIN CONCERN! THEIR NOT SETTING A VERY GOOD EXAMPLE AND SHE SHOULD BE ASHAMED OF HER ACTIONS! AS WELL AS THE B.O.D; IF NOTHING IS DONE TO RESOLVE THE ISSUE, IMMEDIATELY!
