I live in a golf course community where the builder is still active. We have been advised by the builder that in about 30 days all our "For Sale" signs (which we now have to have inside our home windows) will be prohibited. We are an adult community- one must be 55 or older and we have a lot of homes for sale right now.

We live in Pasco County, Florida.

Can the Builder or HOA prohibit our For Sale signs?

I would check your legal documents for this. Maybe it is something you cannot do and they have decided to start enforcing this rule that has been effect all along. If it is not in the covenants then I would question the reason behind the builder not allowing the signs at this point.

Rosemary, the HOA can prohibit for sales signs if they are not allowed in the Declaration of CC&Rs. For example if there may be a restriction "no signs allowed". However, that could be superceded by a city or county ordinance or a state statute but probably such an item may not addressed. Get advise from your real estate agent on this. If the developer has relinquished control of the HOA you could also try to amend the Declaration.
