A new Illinois condo HOA! While it's clearly stated in both the Illinois Condo Act and in our own CCRs and Bylaws that we have access to 'financial and accounting records' it doesn't specifically include federal or state tax returns. Are they considered financial/accounting records?

What would it take for a member of the HOA to get a copy of them?

Thanks, Beth

Yes you should have access to them. They are records of the Association and not 'private' member documents.

I wonder if your Association is a not for profit corporation if you could get a copy through the Freedom of Inormation Act or such (if your Board won't give them to you). Worth investigating.

What you would need to do is request to see the tax returns in writing to the Board of Directors or Management Company if you have one.
