Thank you so much for the quick responses. From the replys I've read, we are thinking along the same lines. I have made contact with the local Parks & Recreations as all of our retention ponds are "conservation" land and they run-off into a small river. They are going to come out and take a look and then I can get a Petition written up to vote on a "quick deed" and turn them over to the agency. The same thing with the private road we have and maintain, also the "fancy" lamp poles we have and get with the Electric Company and stop paying for the fancy ones and get plain utility poles in. I will probably end up with many petitions, but I'm not sure how to go about drawing one up legally.

I live in Orange County Florida and we have been hit by down-sizing and of course the "recesion". We only need 2/3 votes to dissolve the association, but not sure how to begin............I'm learning really fast though. If you have any suggestion, please bring-them-on

good luck with turning over your common areas! if your Parks/Rec will take them and maintain them, you are in the lucky few... very few HOA's here have had luck with getting the city to take on the mowing/drainage/trimming/liability of a common area. Let's hope they don't hit you with a "special assessment tax" for the annual costs of doing that.

Are you really going to save on the lamp post switching? Did the HOA buy the posts, or are you renting them? if bought, isn't that money already spent? New posts, even cheap ones, are just additional monies out the drain. Are you reducing the amount of POWER you are drawing by replacing them?

Actually, as long as they take them...............I can always call code-enforcement to make sure they keep them half-way up. We rent the lamp pole; I am probably going to call their bluff and propose taking them out for the cheaper ones, but I don't think they will do it because it isn't cost-effective and then they might reduce our electric bill............I am now getting creative.

just remember, once the city owns the areas, they can levy any additional taxes they want to the owners for upkeep. So, the more you call to complain, the more they can specially assess you to raise the money for the grass mowing, etc..

Orange County will have to be the people that will control your ponds and the Parks Dept have nothing to do with that area. You might be(probably are) in the Everglades Restoration area because of the river connection. I think that you should be very careful what you wish for as for dissolving your association. There are many different entities that will have to take over control of items that you may not like what you will end up with. And perhaps your PUD will have some restrictions that ultimately tie you into the water systems that you cannot change without great expense to the association. Your light pole are almost insignificant as an issue right now. And let me tell you, the way that State and County governments are struggling now, they really don't want other items to care for on their budgets.

I really don't think that your members who are interested in dissolution of your association have done all of their homework. First of all, have you checked the Statutes 720 for how to dissolve the association? That is your guideline. After you read it you might change your mind. Also, you fall under a water management district, which one it is, I don't know, but they control all of your ponds and waterways. They play real hardball when it comes to this subject.

Goog afternoon JohnM3 I have tried to search online for the information you mentioned for hb769..........the only info I could find was about schools.....not sure how HOAs will be affected.?
