I live in a community of 20 something houses. My left neighbor is pres, my right is treas. The pres has had 3 loud barking dogs that are put out all times of the day and night to the point that my husband and I look outside to see if the dogs are out before leaving the house, so we do not cause them to bark. My across the street neighbor has a clothes line up that she uses as a dog run and leaves her dog to bark all day while she is gone and her neighbors have a dog pen put up right next to it. This creates a lot of dog noise across the street, on top of which we live in peace at the will of our pres and her dogs. We have had a few HOs put in sheds, dog pens, etc without any enforcement of the covenents. We have a nuisance ordinance in our covenents and we have arch control covenents.
We have approached the pres and the across the street neighbor individually. We received bad reactions when we were doing this nicely.
We wrote an "all around" letter about the county and HOA covenents anonomously to all the HOs in the neighborhood.
We addressed the board.
We have contacted and involved the county animal control to the point we have to go to court if we proceed any further and have enough evidence to do so.
We have asked other HOs to get involved and some have.
However our board has not been completely transparent. They have made it sound as if we are just complaining about noise. We feel if the covenents were enforced regarding arch controls, we would not have a problem. They have just acted like we are stupid heads banging pots and pans on a soapbox on our sidewalk being crazy. They have told some HOs that the dog fence is approved, but when we have asked for copies, they ignore the request.
They have really refused to address the arch control covenents to us. The husband of the pres told another HO that you can have dog runs that look like clothes line even if clothes lines are not approvable because this is America.
We have now put our house up for sale and contacted an attorney. Does anyone else see a possible solution? I feel trapped in a property that a county commissioner termed "an instant slum" which is he said is the definition of communities that do not enforce their covenents .
