Absolutely, Jackie, Nice to meet you too. And I agree with Sue's previous post. I do have a few comments about your post just prior to that one, Sue. (and yes, thanks for keeping the debate so straight-forward! God knows I'm no expert, nor do I admit to having all the facts in this one, I'm just going by what I "think" I know or understand from what's been posted!) Sue said: " **** I don't know what vista tan looks like, it seems from what was posted Jackie does not either. But, I do know that tan is a lighter shade of brown. So, factually we don't know much about the colors except what is now existing. {{snip}} *****This is why I would not give a fine to the brown fence HO. However, I would give the HO time to repaint in compliance to what was determined acceptable. If they do not paint in the reasonable time limit, then fine him." My replies: ****I don't know what vista tan looks like either, but it might also be closer to a beige, even, since it keeps being referred to as a "light" color. ****I'm still of the position that it's not necessarily that the color is incorrect, but rather that it obviously was not vetted properly, which is what makes it out of compliance. So the fining would be in lieu of them returning it to the original color, if they refuse to do that, until it is returned to the original color, at which point they can then get the proper approvals. However it appears the board is allowing them the opportunity to get the darker color approved, but it seems they may be either stalling on that or somehow dragging it out -- it seems, based on experience with similar mindsets here, that I think they think they can stall and bluff the board in to just say, "oh. Okay...." and let it go. But, I hope they can get their colors approved. The thing about colors is, popular and/or trendy ones change and evolve over the years. You never know, EVERYONE may want a chocolate brown fence next fall! |

The reason I asked Jackie what the fine was for before was for this reason. If you are fining them because the color is unapproved I can buy that...if you were fining because they didn't seek approval then I would have an issue because how many other people did it before. that is my parting statement...I will bow out of this conversation |
