Where do I start, our developer still apparently holds all the votes over our actual home owners and took the board over and assigned the President to an outside person of his choice that doesn't even live in the neighborhood. The new President is a convicted felon and has no ties to our community. We had a meeting on the 8th of June and it was very interesting, we found out that the President himself was mowing the entrance and billing $400.oo a month and it only gets cut once a month. $320 was given to a unknown person for holding a that is displayed before each meeting at there house. By the way the entrance can be mowed in 30 minutes. What can we do?????????? Help Please |

| The first thing I would due is review the bylaws. Typically, language in the bylaws state that a board member is NOT compensated in any fashion with the HOA. In other words, they should not get a check for either board duties or compensated for landscaping, pool work, etc... This is a conflict of interest. Mark |

board members cannot be compensated for their work as a board member. However, if they are performing work as a contractor (mowing, electrical, etc.), they CAN be compensated. However, there must be a visible bidding process used to assign that contract to the board member (ie, a proposal for bids, sealed bids accepted, etc) that must be transparent and auditable. There must also be a review period for all contracts, and a chance for other companies to submit their bids for upcoming year(s), etc.. |
