Friends, I know there has been a lot written on hoatalk re the how to's on fines and fining processes vary from HOA to HOA. Our bylaws do not refer to R&R violations. I am interested if the State Planned Community Act details exactly what the process should be once a homeowner is found in violation. I cannot seem to find anything in this document on violations. I'm not interested in assessment problems and liens, etc., I want to know the best process and the most 'legal' process to use for instituting a fine. Thanks.

OK, sorry can't help you. It would be helpful if everyone when asking for advice would post what State they are asking for.

Paul, check your Declaration. It should authorized the Association to establish Rules and Regulations. If so, and neither the Declaration nor the By-laws allow the Board to establish R&R they can be approved at a members meeting. Once Rules &Regs are establish and distributed to all members then they can be enforced. I have posted example Rules & Regs for Enforcement of Covenants and Rules and for Delinquent Assessments which should be established before instituting fines.
