Isn't one of the 'duties' of a Management Company to advise the Board and its members on proper procedures and statutes that may effect the business of the Board, the HOA, and its members?

Yes Frank, if they know they should provide guidance. The problem is some do not know and some MCs discourage their Agents from doing this for fear of legal reprecussions.

Roger, is there any suggestions on how to get the MC to do their job and the possible legal repercussions if they don't offer advise?

Frank, perhaps you can contact the owner of the MC and advise them of your desires. If they will not provide an Agent who will fill your needs the only other option is to look for a MC that can. I'd bet your management Agreement probably does not require them to offer advise; therefore no legal recourse.
