We currently have 8 homes in our HOA. 5 Homes on one side with their own driveway and 3 homes on the other side with their own driveway. There has been continuous requests from the side with 5 homes that they want a new driveway and the side with 3 homes refuses to pay this large amount when it does not even benefit them. Is there a way to relieve this constant argument between the two sides and make it so the other side is not responsible for the damage that is done on the other side due to possible neglect?

Depends on how your hoa is set up? Does everyone pay dues for the betterment of the association? If so there are always going to be things that better some and have no effect on others. My question would be why does the driveway need to be replaced, is it really a maintenance issue? In our subdivision it requires 2/3 vote to have a special assessment, not sure how yours is set up. Those are questions I would be asking and finding the answers to. There is also going to come a time when the 3 homeowners want or need something on their side, they might want to think about that as well.
