Two weeks prior to our sending out the ballots a group of member's (backed by some of the re-called Board skimming from the general account) sent out proxies to the entire Association. They tried to disrupt our annual meeting and confuse those in attendance. The meeting was nightmare and we were forced to adjourn. They are claiming out election is not legal to further confuse the membership. Thier demand is that all five positions on the Board be up for election. We have always had staggered elections and this year there are only two openings on the Board. Note: A number of the claimants were previous Board member's that served two and in some cases three terms, a typical case of what's good for the goose is not good for the gander. My question, has anyone ever experienced this type of roadblock?

Can you clarify? Are the seats not up for election currently filled by members who were elected? Are they serving an additional non-elected term or a term exceeding what is allowed by you Covenants?

Thank you for your response.....

The 3 seats are being held by 2004 elected Board members,
2005 will be their 2nd term. Since my last posting the votes
where tallied and myself and another member received the
most votes, we posted the illegal groups names on our election ballot and the majority of our membership have a
better memory than we thought, their group received very
few votes. Note on the illegal ballot sent they didn't
include my name or the other member that received the majorities votes. I received an e-mail from one of their
group member's stating our election was illegal and they
plan to take legal action. They are going to great
lengths to take back control.

I understand your curiosity. However, with a thread that is 6 years old and the changing of laws, what was the solution back then may not be the solution today.
