Have a situation where the developer did not establish the HOA when he completed the community. His contract with HO says there will be one, but he completed building 3 years ago. There are 8 high-end homes in total. HO have been paying dues to maintain the commons, but there is no way to enforce the covenant, ACC. Had a meeting last week, 6 of the HO will sigh the contract and agree to the covenant. We have established a non-profit entity, and a committee. The issue is this, 1 HO refuses to sign, although he has been paying dues for 2 years. According to GA law, can we force him by majority? Can we hold him accountable to comply with the covenant and ACC? Naturally he is the largest violater of the covenant.
